Neravnopravnost se osobito o\u010dituje prilikom prijave za posao i testiranja kada OSI nisu u ravnopravnom polo\u017eaju, iako im se zakonski garantira zapo\u0161ljavanje pod jednakim uvjetima, \u0161to utje\u010de na rezultate testiranja te u kona\u010dnici i na odabir najboljeg kandidata za radno mjesto.<\/p><p>Zakon o profesionalnoj rehabilitaciji i zapo\u0161ljavanju OSI je zakon kojim se \u0161tite osobe s invaliditetom u svijetu rada. Zakonom su propisana prava koje osobe s invaliditetom imaju vezano uz profesionalnu rehabilitaciju, zapo\u0161ljavanje i rad, ali i uvjete koji se poslodavci moraju pridr\u017eavati.<\/p><p>Zakon o izmjenama i dopuni Zakona o profesionalnoj rehabilitaciji i zapo\u0161ljavanju osoba s invaliditetom (\u201eNarodne novine\u201c, br. 32\/20) donesen je 2020. godine koji nadopunjuje Zakon o profesionalnoj rehabilitaciji i zapo\u0161ljavanju osoba s invaliditetom i opisuje posebne okolnosti koje se nisu mogle predvidjeti i na koje se nije moglo utjecati, a sve u svrhu o\u010duvanja radnih mjesta i zadr\u017eavanja zaposlenosti.<\/p><p>Iako je veliki problem zapo\u0161ljavanje OSI, tako\u0111er se treba spomenuti da je potrebno obratiti pa\u017enju i za slu\u010dajeve zadr\u017eavanja radnog mjesta kada se invaliditet pojavi tijekom radnog vijeka.<\/p><p>Poslodavci bi trebali provoditi razumnu prilagodbu radnog mjesta za OSI kako bi mogle pokazati svoja znanja i kompetencije za obavljanje posla i sposobnosti za odre\u0111eno radno mjesto.<\/p><p>Ukoliko ste osoba s invaliditetom ili poslodavac koji planira zaposliti osobu s invaliditetom, Zakon o profesionalnoj rehabilitaciji svakako je dokument koji \u0107e vam pomo\u0107i da ostvarite svoja prava i du\u017enosti prilikom uspostave radnog odnosa.<\/p><p>Cijele\u00a0Zakone mo\u017eete prona\u0107i na:<br \/><a href=\"https:\/\/www.zakon.hr\/z\/493\/Zakon-o-profesionalnoj-rehabilitaciji-i-zapo%C5%A1ljavanju-osoba-s-invaliditetom\" target=\"_blank\" rel=\"noopener\">https:\/\/www.zakon.hr\/z\/493\/Zakon-o-profesionalnoj-rehabilitaciji-i-zapo%C5%A1ljavanju-osoba-s-invaliditetom<\/a><br \/><a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2020_03_32_696.html\" target=\"_blank\" rel=\"noopener\">https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2020_03_32_696.html<\/a><\/p><ul><li>BRO\u0160URA &#8220;VODI\u010c ZA POSLODAVCE&#8221;<\/li><\/ul><p>Hrvatski zavod za zapo\u0161ljavanje (HZZ) dr\u017eavna je institucija koja ima glavnu ulogu u zapo\u0161ljavanju hrvatskih gra\u0111ana pa samim time i osoba s invaliditetom. HZZ u partnerstvu sa Zavodom za vje\u0161ta\u010denje, profesionalnu rehabilitaciju i zapo\u0161ljavanje osoba s invaliditetom (ZOSI) provodi \u201eProgram radnog treninga za OSI na za\u0161titnim radnim mjestima u okviru za\u0161titnih radionica i integrativnih radionica u Republici Hrvatskoj\u201c. Za\u0161titne i integrativne radionice olak\u0161avaju zapo\u0161ljivost osoba s invaliditetom kojima je u procesu zapo\u0161ljavanja potrebno dodatno osposobljavanje, podr\u0161ka i prilago\u0111enost radnog mjesta.<\/p><p>Centri za profesionalnu rehabilitaciju (CPR), ZOSI i HZZ slu\u017ebe su koje samostalno i u suradnji pru\u017eaju\u0107i usluge u vlastitom djelokrugu doprinose ve\u0107em broju zapo\u0161ljavanja osoba s invaliditetom kroz razli\u010dite edukacije, osposobljavanja i suradnju s potencijalnim poslodavcima. ZOSI razvija model profesionalne rehabilitacije, a CPR ga provodi. HZZ upu\u0107uje osobe u CPR kako bi se dodatno osposobile i stekle kompetencije te pove\u0107ale \u0161anse\u00a0 za ulazak u svijet rada.<\/p><p>HZZ izradio je Vodi\u010d za poslodavce \u201eKako zaposliti osobu s invaliditetom?\u201c. Bro\u0161ura na jednom mjestu okuplja informacije koje poslodavcima sve bitno vezano uz mogu\u0107nost zapo\u0161ljavanja osoba s invaliditetom. U bro\u0161uri je na po\u010detku rije\u010d o Zakonu o profesionalnoj rehabilitaciji i Hrvatskom zavodu za zapo\u0161ljavanje, a nakon toga detaljnije o Fondu za profesionalnu rehabilitaciju i zapo\u0161ljavanje osoba s invaliditetom i ostalim mogu\u0107nostima.<\/p><p>Vodi\u010d mo\u017eete prona\u0107i ovdje:\u00a0<a href=\"https:\/\/www.hzz.hr\/UserDocsImages\/Kako_zaposliti_OI.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/www.hzz.hr\/UserDocsImages\/Kako_zaposliti_OI.pdf<\/a><\/p><ul><li>FILMOVI O ZAPOSLENIM OSOBAMA S INVALIDITETOM\u00a0<\/li><\/ul><p>U prosincu 2021. u evidenciji Hrvatskog zavoda za zapo\u0161ljavanje ukupno je evidentirano 125 715 nezaposlenih osoba od koji je evidentirano 6 179 osoba s invaliditetom koje su vi\u0161e od godinu dana u evidenciji. Od tog broja, 29 % tih osoba nema evidentiranog radnog iskustva.<\/p><p>Iako postoje\u0107i podaci nisu optimisti\u010dni, u nastavku donosimo linkove za filmove koju tu statistiku pobijaju. Kroz filmove donosimo primjere kako osobe s invaliditetom mogu biti izvrsni radnici i uz razumnu prilagodbu mogu biti ravnopravni \u010dlanovi kolektiva u kojima rade pa tako i u dru\u0161tvu u kojem \u017eive.<\/p><p>\u00a0 \u00a0 \u00a0 \u00a0\u00a01. \u201eZAPO\u0160LJIVI SMO\u201c<\/p><p>Kroz pet pri\u010da o zapo\u0161ljavanju Luka, Ivana, Tomislav i Marina, Roland i Kristina upoznaju nas s raznolikostima izazova s kojima su suo\u010dene osobe s mi\u0161i\u0107nom distrofijom, bilo da je to na otvorenom tr\u017ei\u0161tu rada, da su zaposlene u udruzi ili da je rije\u010d o samozapo\u0161ljavanju.<\/p><p>Film \u201eZapo\u0161ljivi smo\u201c izradio je SDDH u okviru projekta \u201ePodr\u0161kom do inkluzije\u201c te je premjerno prikazan na Danu otvorenih vrata udruga 2021.<\/p><p>Film mo\u017eete prona\u0107i na YouTube stranici SDDH:\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=Pi1SZjw5Pi0\" target=\"_blank\" rel=\"noopener\">https:\/\/www.youtube.com\/watch?v=Pi1SZjw5Pi0<\/a><\/p><p>\u00a0 \u00a0 \u00a0 \u00a02. &#8220;UM IZNAD PREDRASUDA&#8221;<\/p><p>Pri\u010da o sposobnostima i mogu\u0107nostima zaposlenih osoba s invaliditetom kao i perspektiva poslodavaca te strah i predrasude koji proizlaze iz nepoznavanje radnih potencijala osoba s invaliditetom tema je filma o zapo\u0161ljavanju, u kojemu se isti\u010de perspektiva zapo\u0161ljavanja osoba s invaliditetom kojoj zna\u010dajan doprinos daje razli\u010ditost. Film je izra\u0111en s ciljem poticanja zapo\u0161ljavanja osoba s invaliditetom.<\/p><p>Cijeli Film je dostupan na SOIH YouTube stranici:\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=aU201i2iXDY\" target=\"_blank\" rel=\"noopener\">https:\/\/www.youtube.com\/watch?v=aU201i2iXDY<\/a><\/p><ul><li>PRAVILNIK O POTICAJIMA PRI ZAPO\u0160LJAVANJU OSOBA S INVALIDITETOM<\/li><\/ul><p>Ministarstvo rada, mirovinskog sustava, obitelji i socijalne politike izdao je Pravilnik kojim se propisuju uvjeti i na\u010dini na koji poslodavci mogu ostvariti poticaj pri zapo\u0161ljavanju osoba s invaliditetom koji osigurava Zavod za vje\u0161ta\u010denje, profesionalnu rehabilitaciju i zapo\u0161ljavanje osoba s invaliditetom.<\/p><p>Pravilnik je stupio na snagu 1.1.2021. godine.<\/p><p>Pravilnik dostupan je na:\u00a0<a href=\"https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2020_12_145_2804.html\" target=\"_blank\" rel=\"noopener\">https:\/\/narodne-novine.nn.hr\/clanci\/sluzbeni\/2020_12_145_2804.html<\/a><\/p><ul><li>RAZUMNA PRILAGODBA RADNOG MJESTA\u00a0<\/li><\/ul><p>Osobe s invaliditetom mogu ostvariti svoje potencijale i biti u\u010dinkovite na radnom mjestu ako su im osigurani uvjeti rada i pretpostavke za ravnopravno sudjelovanje\u00a0 na tr\u017ei\u0161tu rada.<\/p><p>Prema Konvenciji UN-a o pravima osoba s invaliditetom, koju je RH ratificirala 2007. godine, razumna prilagodba zna\u010di potrebnu i odgovaraju\u0107u prilagodbu i pode\u0161avanja, koji ne predstavljaju neproporcionalno ili neprimjereno optere\u0107enje, da bi se u pojedina\u010dnom slu\u010daju, ondje gdje je to potrebno, osobama s invaliditetom osiguralo ravnopravno u\u017eivanje ili kori\u0161tenje svih ljudskih prava i temeljnih sloboda na ravnopravnoj osnovi s drugima. Odredbom \u010dl. 7. st.1. Zakona o profesionalnoj rehabilitaciji i zapo\u0161ljavanju osoba s invaliditetom (NN 157\/13, 152\/14 i 39\/18, 32\/20) propisano je da se osobe s invaliditetom mogu zaposliti na otvorenom tr\u017ei\u0161tu rada ili pod posebnim uvjetima, uz obvezu osiguranja razumne prilagodbe od strane poslodavca prilikom provedbe testiranja i\/ili intervjua u okviru natje\u010dajnog postupka te obvezu razumne prilagodbe radnog mjesta, uvjeta i organizacije rada.\u00a0<\/p><p>Priru\u010dnik s preporukama za razumnu prilagodbu radnog mjesta obuhva\u0107a primjenjive savjete i prikazuje primjenu razumne prilagodbe u svakodnevnom radu i komunikaciji s osobama s invaliditetom. Podcaste jedne od emisija u kojoj gostuje zaposlenica\u00a0Zavoda za vje\u0161ta\u010denje, profesionalnu rehabilitaciju i zapo\u0161ljavanje osoba s invaliditetom (ZOSI) i detaljnije govori o mogu\u0107nostima zapo\u0161ljavanja osoba s\u00a0invaliditetom i kvotnom zapo\u0161ljavanju mo\u017eete \u010duti na:\u00a0<a
